Rent Stabilized Co-op/Condo Succession Rights

 

Many rent regulated tenants who did not purchase the co-op/Condo in a non-eviction plan are now reaching the age when they may ask a family member to move in with the tenant as a caretaker. Thus succession becomes now of vital concern. The landlords may take action to nullify those succession rights.

It is important that tenants who may face this problem now or in the future voice their concern to their political representatives at the City and State levels.

This should be done now for your sake and for the sake of your fellow tenants living in like situations.

As you should be aware the Pataki administration is no friend of the tenants.

It is my concern that if landlords attack succession, taking caretakers into Court on litigation of this nature, that a tenant’s successor fighting alone will find such litigation too costly to defend even if the tenant would win.

The best place to fight this battle is not in the Courts but to insist that our representatives remedy this matter of protection of succession rights relating to your rent regulated home.
